Terms of Service
These Terms of Service ("Terms") govern your use of the Cultivar website at gocultivar.com and the products and services offered by Cultivar Labs LLC ("Cultivar", "we", "us"). Some products have additional product-specific terms. Where they conflict, the product-specific terms control for that product.
1. Who we are
Cultivar Labs LLC is a New Jersey company that builds focused software tools, including Nectar, Tendril, Trellis, Canopy, and Propagator. Each product runs on its own, with its own sign-in and pricing.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use our products and services.
3. Accounts
Most products require an account. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. Notify us promptly of any unauthorized use.
4. Plans, billing, and payments
Our products may offer free and paid plans. Paid plans are sold and processed by Lemon Squeezy, LLC, our Merchant of Record and authorized reseller, who handles payment, invoicing, and applicable taxes.
- Subscriptions renew automatically each billing period until canceled.

- We may change prices or plan features with notice. Changes apply to the next billing period.
5. Your content
You retain ownership of the information you submit (your "Input") and of the materials our products generate for you (your "Output"). You grant us a limited license to process your Input and Output solely to provide and improve the service. We do not claim ownership of your content.
6. Acceptable use
You agree not to:
- Submit false, unlawful, or infringing content.
- Use our products in violation of any applicable law or third-party rights.
- Reverse engineer, scrape, overload, or interfere with the service.
- Resell or redistribute the service without our written permission.
7. AI output disclaimer
Where our products generate content with AI, that content can contain errors or omissions. We do not guarantee any specific result or outcome. You are responsible for verifying the accuracy and suitability of all output before relying on or publishing it.
8. Intellectual property
The Cultivar software, designs, and trademarks are owned by Cultivar Labs LLC and protected by law. These Terms grant you no rights in our intellectual property beyond the right to use the service as permitted.
9. Termination
You may stop using our products and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that creates risk or legal exposure for us or others. Sections that by their nature should survive termination will survive.
10. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, Cultivar will not be liable for indirect, incidental, or consequential damages, or for lost profits or opportunities. Our total liability for any claim relating to a product will not exceed the amount you paid for that product in the 12 months before the claim.
12. Indemnification
You agree to indemnify and hold Cultivar harmless from claims arising out of your content or your use of the service in violation of these Terms or applicable law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Continued use after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of New Jersey, USA, without regard to conflict-of-law rules.
